Terms of Service for nyra.gg

1. Scope and Eligibility

By accessing nyra.gg, you enter into a legally binding agreement with nyra.

• Accessibility: Our services are available to everyone. However, to enter into binding sales contracts, you must be at least 18 years old or have explicit parental consent.
• Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Our Role: Marketplace & Direct Seller

nyra operates as a hybrid platform:

• Facilitator: In most cases, nyra provides a marketplace where third-party sellers list their cards. For these transactions, the contract of sale is exclusively between the Buyer and the Seller. nyra is not a party to that contract.
• Direct Seller: Occasionally, nyra may list and sell cards directly. In these instances, your contract of sale is with nyra. Such listings will be clearly identified.
• No Guarantee: For third-party sales, nyra does not guarantee the quality, authenticity, or delivery of items, though we provide tools to help resolve disputes.

3. Fees and Payments

• Currency: All transactions are processed in Swiss Francs (CHF).
• Fee Structure: To keep the lights on and the platform running, we charge a total fee of approximately 8% per successful sale. This consists of:
  • nyra Platform Fee: 5%
  • Payment Processing (Stripe): 3% per transaction.
• Direct Payouts: Payments are processed via Stripe and, under our current setup, are credited directly to the seller’s connected account upon a successful transaction.

4. Shipping and Risk of Loss

• Tracking Recommendation: We highly recommend that all sellers use tracked shipping. If a seller chooses untracked shipping for a high-value item, they do so at their own risk.
• Risk of Loss: As per the Swiss Code of Obligations, the risk of loss passes to the buyer once the item is handed over to the carrier. However, if an item is not as described or is lost due to a seller’s failure to package it securely, the seller remains liable.

5. Returns and Disputes

• Professional Sellers: Unless otherwise stated in a seller’s individual profile, professional sellers on nyra follow the Swiss standard: there is no statutory unconditional right of return (no "cooling-off" period) once a purchase is made.
• "Not as Described": If a card arrives damaged or does not match the listing (e.g., "Near Mint" vs. "Damaged"), the buyer has 48 hours from the time of delivery to open a dispute.
• Finality: If no dispute is raised within 48 hours of delivery, the transaction is considered final and the funds are fully released.

6. Prohibited Conduct

You may not:

• Sell counterfeit or proxy cards as authentic.
• Engage in "shill bidding" or price manipulation.
• Use automated bots to scrape data or manipulate the marketplace.

7. Intellectual Property

All content, code, and logos on nyra.gg are the property of nyra. By uploading images of your cards, you grant nyra a non-exclusive license to use those images for the purpose of operating and promoting the marketplace.

8. Limitation of Liability

nyra is not liable for any indirect, incidental, or consequential damages arising from the use of the platform. We provide the service "as is" and "as available."
